Terms of Service

1. Scope and Customer Base

These General Terms and Conditions (GTC) apply exclusively to orders placed by customers through our online shop www.soohotrightnow.com (hereinafter SHRN). We do not recognize any deviating terms of the customer or third parties unless we have expressly agreed to their application.
The offering in the SHRN shop is directed exclusively at consumers (any natural person who concludes the contract for a purpose that can be attributed neither to their commercial nor their independent professional activity, § 13 BGB [German Civil Code]).

2. Offer, Order Process, and Conclusion of Contract

The presentation of products within the online shop does not constitute a legally binding offer, but rather a non-binding online catalog.
By clicking the „Add to Cart“ button, you can place desired goods in the shopping cart without obligation. You can view the cart at any time via the cart symbol and also remove the items placed there. If you wish to purchase the items contained in the cart, you proceed to order processing via the „Checkout“ button and then enter the required data. Registration is not mandatory. After entering your data and selecting the payment method, the details of your order will be displayed again. There you can review your entries one final time and, if necessary, correct them again. By clicking the „Order with obligation to pay“ button in the final step of the order process, you submit a binding order for the selected goods.
Immediately after submitting your order, you will receive an email confirming receipt of your order (order receipt confirmation). However, this does not yet constitute acceptance of your order offer, but merely serves to inform you that your order has been received by us. The purchase contract is only concluded when we confirm the order in a further email (order confirmation) or when delivery of the goods takes place and we thereby accept your order offer. Should you not receive an order confirmation or delivery of goods within three business days of placing your order, you are no longer bound by your order.

4. Right of Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take(s) possession of the goods.

To exercise your right of withdrawal, you must inform us

by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notification of exercising the right of withdrawal before the withdrawal period expires.

Please note that the right of withdrawal applies only to purchases of a private nature. Commercial purchases of any kind (e.g., for the purpose of reselling the goods) are excluded from the right of withdrawal and cannot be reversed/returned.

Consequences of Withdrawal

If you withdraw from this contract, we must repay to you all payments we have received from you, including delivery costs (with the exception of additional costs arising from your having chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal from this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case at the latest within fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You only have to pay for any diminished value of the goods if this diminished value is due to handling of the goods that is not necessary for checking their condition, properties, and functioning.

5. Storage of the Contract Text

Your order and the order data you have entered are stored by us and can be requested from us. In addition, you have the option of printing out your order and the data entered during the order process. If you have registered as a customer, you can also view your order data at any time in the customer area by entering your personal access data. The order data is also transmitted within the framework of the confirmation emails to the email address you provided.

6. Delivery

Delivery takes place within the delivery period shown on the respective offer page to the delivery address you provided. We deliver with DHL ( www.dhl.de ) and Fedex. The period relevant for determining the delivery date begins, in the case of payment by advance payment, on the day of receipt of the full purchase price (including VAT and shipping costs); in the case of payment by PayPal, as soon as receipt of payment occurs at PayPal; in the case of payment by credit card, upon receipt of the order confirmation. Where possible, you will receive your order in a single shipment. Should separate shipment be necessary for technical or logistical reasons, for example because your order contains items that have to be packaged separately or transported differently, no additional costs will be incurred by you as a result.

7. Prices

All prices stated here are inclusive of the legally prescribed value-added tax (19%). All prices stated are subject to shipping costs where applicable.

8. Payment

Payment by Advance Payment

You can pay by advance payment. To do so, transfer the invoice amount specified in the order process to the designated account. If you select the advance payment method, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.

Payment by PayPal

PayPal is an online payment method that works by linking to your bank account or your credit card. In order to be able to pay with PayPal, you must have a PayPal customer account. If you do not yet have a PayPal customer account, you can open one if desired during the order process. The provider of the payment service is PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. Further information about PayPal can be found at www.paypal.de .

Payment by Credit Card (MasterCard, Visa, American Express)

If you wish to pay by credit card, please select the corresponding card during the order process and enter the required data in the fields provided for this purpose. Your credit card account will be charged immediately after we have confirmed your order. Payment processing is carried out in encrypted form via the payment service provider Shopify Payments, operated by Shopify International Limited, 2nd Floor 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland.

9. Vouchers

Unless otherwise stated, the following applies to vouchers and discount promotions:
Cash payout is not possible.
The discount applies only to items that are not already reduced.

10. Retention of Title

The goods remain our property until full payment has been made.

11. Warranty

In the case of defects in the delivered goods, the statutory rights apply.

12. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as mandatory international consumer protection law does not conflict with this.

13. Contract Language

The contract language is German.

14. Final Provisions

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall not be affected thereby.
